In this “Response to Critics,” Cathleen Kaveny continues the conversation in the JRE symposium centered on her recent book, Prophecy without Contempt: Religious Discourse in the Public Square. The book's central argument is that adequate discussion of contention in the contemporary public square requires attending to matters of rhetoric, particularly the rhetoric of prophetic indictment. Kaveny engages the comments of four interlocutors: Alda Balthrop-Lewis, James Childress, William Hart, and Martin Kavka. Cathleen Kaveny's Prophecy Without Contempt seeks to reorient the conversation among religious ethicists and political theorists about religion in public life. Rather than focus on religious speech in general, Kaveny distinguishes deliberation and indictment as forms of discourse, and she subjects indictment to ethical evaluation. She aims to constrain the public exercise of inordinate indictment, while encouraging prophetic indictment that meets the demands of justice. While the book is a much-needed corrective, Kaveny's focus on the powerful rhetoric of prophetic (...) indictment omits the harms that can come to the body politic from unjust silence. This essay takes a synthetic and critical approach to the scattered pieces of art criticism and aesthetic theory authored by Louis Althusser. Connecting these texts to his larger philosophical and political project, we argue that these reflections make an independent contribution to its worth and that they offer different perspectives on lingering theoretical problems. We piece together the insights that form the core of the Althusserian approach to aesthetics and show how these are formulated and trace how their formulations take (...) shape in relation to the work of different authors and artists. In addition to helping us better understand his overall project, Althusser’s aesthetic theory is, we argue, a powerful and original contribution to Marxist aesthetics. Specifically, it points us to the idea that we need to take aesthetic production seriously as a practice with its own specificity – one that has its own logics of determination, rituals of production, circulation, and consumption, one that commands effects that need to be theorized on their own terms. Introduction The bioethics literature reflects significant interest in and concern with the use of genetic and genomic information in various settings. Because psychiatric treatment and research raises unique ethical, legal, and social issues, we conducted a scoping review of the biomedical, bioethics, and psychology literature regarding the application of genetic and genomic tools to psychiatric disorders (as listed in the DSM-5) and two associated behaviors or symptoms to provide a more detailed overview of the state of the field. Objectives The (...) primary objective was to examine the available bioethics, biomedical, and psychology literature on applying genetic and genomic tools to psychiatric disorders (other than neurodevelopmental disorders) and two behaviors or symptoms sometimes associated with them (aggression or violence and suicidality) to identify the disorders to which these tools have been applied, the contexts in or purposes for which they have been applied, the ethical, legal, or social concerns associated with those uses, and proposed recommendations for mitigating those concerns. Methods We used Arksey and O’Malley’s scoping review framework: (1) identify the research question; (2) identify relevant studies; (3) select studies; (4) chart the data; and (5) collate, summarize, and report results (2005). We relied on Levac et al. to inform our application of the framework (2010). The PRISMA extension for scoping reviews checklist informed our reporting (2018). We searched three electronic databases MEDLINE (PubMed), Embase, and PsycInfo (EbscoHost) for peer-reviewed journal articles in English to identify relevant literature. One author screened the initial results and additional screening was done in consultation with other authors. A data extraction form using DSM-5 diagnostic categories (excluding neurodevelopmental disorders) was developed and two authors independently each reviewed approximately half of the articles. Inter-rater reliability was ensured by double-coding approximately 10% of the papers. An additional author independently coded 10% of the articles to audit the data. Results In 365 coded publications, we identified 15 DSM-5 diagnostic categories in addition to the two pre-selected behaviors or symptoms (aggression or violence and suicidality) to which genetic or genomic tools have been applied. We identified 11 settings in or purposes for which these tools were applied. Twenty-two types of ethical, legal, or social concerns associated with the application of genetic or genomic tools to these disorders or behaviors/symptoms were identified along with 13 practices or policies that could mitigate these concerns. Conclusion Genetic and genomic tools have been applied to a wide range of psychiatric disorders. These raise a range of ethical, legal, and social concerns. Additional research is warranted to better understand the concerns and effective ways to address them. Advancing the literature to identify relevant ethical, legal, or social concerns and solutions to those problems likely requires greater attention to specific applications of genetic or genomic tools to particular psychiatric disorders and associated behaviors/symptoms as well as broad stakeholder engagement. We agree that conceptualisation is key in understanding the brain basis of emotion. We argue that by conflating facial emotion recognition with subjective emotion experience, Lindquist et al. understate the importance of biological predisposition in emotion. We use examples from the anxiety disorders to illustrate the distinction between these two phenomena, emphasising the importance of both emotional hardware and contextual learning.

With each novel infectious disease outbreak, there is scholarly attention to healthcare providers’ obligation to assume personal risk while they care for infected patients. While most agree that healthcare providers have a duty to assume some degree of risk, the extent of this obligation remains uncertain. Furthermore, these analyses rarely examine healthcare institutions’ obligations during these outbreaks. As a result, there is little practical guidance for healthcare institutions that are forced to weigh whether or when to exclude healthcare providers from (...) providing care or allow them to opt out from providing care to protect themselves. This article uses the COVID-19 pandemic to examine the concept of risk and the professional duties of both healthcare providers and healthcare institutions, and proposes a framework that can be used to make concrete institutional policy choices. This framework should be a useful tool for any hospital, clinic, or health agency that must make these choices during the current pandemic and beyond. (shrink)

According to many of its proponents, shared decision making ("SDM") is the right way to interpret the clinician-patient relationship because it respects patient autonomy in decision-making contexts. In particular, medical ethicists have claimed that SDM respects a patient's relational autonomy understood as a capacity that depends upon, and can only be sustained by, interpersonal relationships as well as broader health care and social conditions. This paper challenges that claim. By considering two primary approaches to relational autonomy, this paper argues that (...) standard accounts of SDM actually undermine patient autonomy. It also provides an overview of the obligations generated by the principle of respect for relational autonomy that have not been captured in standard accounts of SDM and which are necessary to ensure consistency between clinical practice and respect for patient autonomy. In medieval writers we find a distinction between body as a substance – corpus-substantia – and body as a quantity – corpus-quantitas (or quantum). One of the earliest uses of this distinction is in works written by Robert Grosseteste in the 1220s. In this paper I explore his use and understanding of this distinction. I argue that he understands corpus-substantia as such as a dimensionless composite of a first corporeal form, corporeity, and prime matter. Corporeity itself is an active power (...) for three dimensions. Through its infinite and necessary self-multiplication corporeity extends the prime matter it informs into three dimensions, thereby resulting in corpus-quantum. I explore how Grosseteste’s conception of corporeity, though probably based on ideas found in Avicenna, diverges from different understandings of Avicenna’s conception of corporeity proposed by medieval and modern commentators. For many philosophical thinkers down through the centuries, the notion of a creation out of sheer nothing has been found to be quite unintelligible. Nevertheless the idea of creation preserves an important insight and needs to be freed from the difficulties of this traditional formulation. Alfred North Whitehead has offered an alternative theory of creation worth exploring: each individual actuality creates itself out of prior creative acts. God then serves to direct this creative process.

Care after research is for participants after they have finished the study. Often it is NHS-provided healthcare for the medical condition that the study addresses. Sometimes it includes the study intervention, whether funded and supplied by the study sponsor, NHS or other party. The NHS has the primary responsibility for care after research. However, researchers are responsible at least for explaining and justifying what will happen to participants once they have finished. RECs are responsible for considering the arrangements. There are (...) ethical and practical issues, in particular when participants may wish to continue on the study intervention after the study. There are also various guidelines and legislation. In order to develop his pragmatist and inferentialist framework, Robert Brandom appropriates, reconstructs and revises key themes in German Idealism such as the self-legislation of norms, the social institution of concepts and facts, a norm-oriented account of being and the critique of representationalist accounts of meaning and truth. However, these themes have an essential ethical dimension, one that Brandom has not explicitly acknowledged. For Hegel, the determination of norms and facts and the institution of normative statuses take place in the (...) context of Sittlichkeit (‘ethical life’). By engaging with some of the more ontologically and ethically substantive points raised by Hegel, I argue that, from a Hegelian perspective, Brandom’s project regarding the social determination of truth and meaning cannot be divorced from ethics, specifically, the ethical dimension of social recognition. Furthermore, I argue that, in real situations (as opposed to ideal ones), claims to normative authority cannot be considered independently from the legitimacy of those claims, a legitimacy that Brandom is unable to reasonably explain. Finally, I argue that a Hegelian solution to the problems facing Brandom’s framework calls into question the unity of reason that is at the core of Brandom’s normative pragmatics and inferential semantics. What in Aristotle corresponds, in whole or (more likely) in part, to our contemporary notion of predication? This paper sketches counterparts in Aristotle's text to our theories of expression and of truth, and on this basis inquires into his treatment of sentences assigning an individual to its kinds. In some recent accounts, the Metaphysics offers a fresh look at such sentences in terms of matter and form, in contrast to the simpler theory on offer in the Categories . I argue (...) that the Metaphysics initiates no change in this regard over the Categories . The point that form is (metaphysically) predicated of matter is a contribution, not to the account of statement predication, but to the analysis of compound material substances. Otherwise put, in our terms Aristotelian form is not - in particular, is not also - a propositional function, but a function from matter to compound material substances. (shrink)

In this article I re-examine the role that aesthetics play in Paulo Freire's pedagogy of the oppressed. As opposed to the vast majority of scholarship in this area, I suggest that aesthetics play a more centralised role in pedagogy above and beyond arts-based curricula. To help clarify Freire's position, I will argue that underlying the linguistic resolution of the student/teacher dialectic in the problem-posing classroom is an accompanying shift in the very aesthetics of recognition. In order to demonstrate the always (...) already aesthetic nature of all education, I will turn to the aesthetic philosophy of Jacques Rancière. Through Rancière we can begin to understand how the pedagogy of the oppressed is predicated on an aesthetic redistribution of the sensible, of what can be seen and what can be heard. As Rancière will confirm, if we truly want to understand the aesthetics of pedagogy, we cannot simply see aesthetics as external to teaching and learning. Rather, education as an aesthetic event has to be taken seriously, and aesthetics should regain primacy in discussions of critical pedagogy. (shrink)

Martha A. Hall’s artists’ books documenting her experience of living with breast cancer offer future health professionals a unique opportunity to sit in the patient’s position of vulnerability and fear. Hall’s books have become a cornerstone of our medical humanities pedagogy at the Maine Women Writers Collection because of their emotional directness and their impact on readers. This essay examines the ways that Hall’s call for conversation with healthcare providers is enacted at the University of New England and provides a (...) model for how such works might be used at other educational institutions to encourage empathy between practitioners and patients by engaging in conversations about anger, fear, and other common reactions to life-threatening illness. We explore the unruly nature of Martha A. Hall’s narratives of illness and care, as well as how the form of the books themselves engages the reader in a deep relationship with Hall’s personal pain and her humanity itself. We explore, too, the cumulative effect of these powerful books on readers who handle them regularly, as we do in our roles as professor and archivist. (shrink)

In this paper, we propose analogies between medical discourse and Edward Said's “Orientalism.” Medical discourse, like Orientalism, tends to favor institutional interests and can be similarly dehumanizing in its reductionism, textual representations, and construction of its subjects. To resist Orientalism, Said recommends that critics—“intellectuals”—adopt the perspective of exile. We apply Said's paradigm of intellectual-as-exile to better understand the work of key physician-authors who cross personal and professional boundaries, who engage with patients in mutually therapeutic relationships, and who take on the (...) public responsibility of representation and advocacy. We call these physician-authors “medical intellectuals” and encourage others to follow in their path. (shrink)

As an accompaniment to the translation into English of Louis Althusser's 'Letter to the Central Committee of the PCF, March 18th, 1966', this note provides the historical and theoretical context necessary to understand Althusser's 'anti-humanist' interventions into French Communist Party policy decisions during the mid-1960s. Because nowhere else in Althusser's published writings do we see as clearly the political stakes involved in his philosophical project, nor the way in which this project evolved from a 'theoreticist' pursuit into a more practical (...) one, the note also argues that the letter is of importance to Althusser scholars, to historians of Marxist thought, and to those interested in the relevance of Althusser's work to contemporary Marxist philosophy. The opening chapter of Genesis makes a lofty claim about the human condition: that humans are created in the image of God. But why can humans image God? This article examines four different interpretations of humans as interpretive animals. Following Martin Heidegger's account of Dasein, I argue that humans are interpretive animals, and as such, are suitable creatures to bear God's image. Humans as interpretive animals function as the image of God, not because of divine fiat; instead, humans in their (...) capacities are open to being the image. My argument is not that the image of God is identifiable as particular human features. Instead, it is the fact that humans have specific capacities that make them interpretive animals (e.g., radical openness, thrownness, malleability) and that these traits are constitutive for what it means to be human. Today, Karl Kautsky is mainly remembered for his polemics against the young Bolshevik regime or as the ‘renegade’ in Lenin’sThe Proletarian Revolution and the Renegade Kautsky, which pillories him for his wavering stance in opposing World War I and his outright hostility to the Russian Revolution of October 1917. Kautsky’s authority as a Marxist theoretician was seriously called into question ever since Lenin’s polemic. During the Cold War in particular, a consensus emerged which suggested that Kautsky’s views of democracy, organisation (...) and revolutionary change had little or nothing to do with the political practice of Russian Bolshevism and the Russian Revolution of 1917. Recently, however, several studies have challenged this consensus. They highlight the profound impact which Kautsky had on the development of Russian Bolshevism and make the case that – prior to his renegacy in 1914 – thinkers such as Lenin and Trotsky viewed Kautsky as the legitimate intellectual heir of Marx and Engels. This article introduces an autobiographical essay written by Kautsky in 1924 and calls for closer engagement with his œuvre as a whole. (shrink)

This re-alignment of political authority from vertical authoritarianism (...) to horizontal citizen relationships is directly related to the views of nature found in the Milesian philosophers. Solon's dike is immanent from the thoughts and actions of the citizens; it is not a divine power pushing down on the polis.Solon's dike has three distinct functions. We propose to demonstrate that Heidegger’s Fundamental Concepts of Metaphysics attempts to think the unthought unity of ontology and theology, or metaphysics, by staging a confrontation between transcendental philosophy and empirical science. Since this topic is a central concern of contemporary continental philosophy, this way of reading Heidegger’s text may prove important for the light it sheds on the deconstruction of this opposition. Heidegger’s own unique way of understanding the relation between philosophy and science involves philosophy in a relation with (...) poetry, and science in a relation with theology. (shrink)

When the elder Dionysius died, Dion, a devotee of philosophy, apparently contrived for the old man's son, namesake, and successor to invite Plato back, believing that the young tyrant could be philosophically educated and convinced to lay down tyranny in favor of a new regime based on the rule of law. The plan was defeated, however, by a combination of Dionysius's dissolute life and opposition by Dion's enemies at court. Dion was exiled, and Plato returned to the Academy. Dion implored Plato to return to Syracuse on the basis of reports of Dionysius II's renewed resolution to take up philosophy and by the tyrant himself (who seems to have made some thinly veiled threats against the still-exiled Dion). Plato's second visit to Dionysius was no more successful than the first, however, and he considered himself fortunate to have escaped with his life. After a meeting at which Plato recounted the events of his final trip, Dion marshaled an expeditionary force, which included volunteers from the Academy, and set out to expel Dionysius II by violence. The effort succeeded, but the new regime was itself riven by faction, and Dion was assassinated in 353.2The principal legacy of this ill-starred episode is contained in the letters that have come down to us under the name of Plato, particularly those numbered seven and eight. Scholarly discussion of Plato's Seventh Letter has usually focused on three questions: the doctrinal content of the letter and its relationship to the doctrinal content of the dialogues; the character of the letter as an apologia for Plato's Syracusan activities; and the general authenticity of the letter. If we take this rhetorical element with sufficient seriousness, we will see that the content of the letter is fully consistent with the teachings of the political dialogues, a point that tells in favor of the authenticity of the letter. Specifically, a focus on the rhetorical character of the letter reveals that its content is determined mostly by what emerges as an effort by Plato to influence his correspondents by moderating their understandable desire for vengeance and thus to forestall further bloodshed and disorder in Syracuse. What is most important about the letter, then, is not so much its account of Plato's actions in Syracuse, but its unveiling of his intentions with respect to Dion's followers. It is not the philosophical-political blueprint, sketched vaguely in the Seventh Letter, that is most important,3 but the concrete effort to mitigate the passions of his correspondents. Read in this light, the letter becomes even more important, since it contradicts the popular image of Plato as a proponent of dangerous political utopianism and portrays a more subtle relationship between philosophy and politics.1. Plato's second visit to Dionysius was no more successful than the first, however, and he considered himself fortunate to have escaped with his life. After a meeting at which Plato recounted the events of his final trip, Dion marshaled an expeditionary force, which included volunteers from the Academy, and set out to expel Dionysius II by violence. The effort succeeded, but the new regime was itself riven by faction, and Dion was assassinated in 353.2The principal legacy of this ill-starred episode is contained in the letters that have come down to us under the name of Plato, particularly those numbered seven and eight. Scholarly discussion of Plato's Seventh Letter has usually focused on three questions: the doctrinal content of the letter and its relationship to the doctrinal content of the dialogues; the character of the letter as an apologia for Plato's Syracusan activities; and the general authenticity of the letter. While the second of these questions focuses correctly [End Page 23] on the rhetorical character of the letter, it ignores the most obvious aspect, namely, the letter's explicit addressees: the friends and comrades of Dion, and their request for political advice. If we take this rhetorical element with sufficient seriousness, we will see that the content of the letter is fully consistent with the teachings of the political dialogues, a point that tells in favor of the authenticity of the letter. Specifically, a focus on the rhetorical character of the letter reveals that its content is determined mostly by what emerges as an effort by Plato to influence his correspondents by moderating their understandable desire for vengeance and thus to forestall further bloodshed and disorder in Syracuse. What is most important about the letter, then, is not so much its account of Plato's actions in Syracuse, but its unveiling of his intentions with respect to Dion's followers. It is not the philosophical-political blueprint, sketched vaguely in the Seventh Letter, that is most important,3 but the concrete effort to mitigate the passions of his correspondents. Read in this light, the letter becomes even more important, since it contradicts the popular image of Plato as a proponent of dangerous political utopianism and portrays a more subtle relationship between philosophy and politics.1. The Laws is the most political of the Platonic dialogues. It also contains the most detailed discussion of theology in the Platonic corpus, indeed, one of the most extensive accounts of this subject in all of classical literature. This dissertation addresses the question of why a philosopher concerned with politics should need to undertake such a sustained discussion of the gods. Most scholars have seen the theology of the Laws either as instrumental to the dialogue's political program or as the (...) premise from which that program is deduced. This dissertation opposes both of these reductionist accounts. When one reads the Laws as a whole and on its own terms, the theology emerges naturally from the inquiry into political regimes. ;In order to show this, I undertake an investigation of the nature of law and lawgiving through an examination of Plato's Minos. Next I examine Plato's critical political science through a discussion of the key concepts of that science as employed in the Laws. I then look at the psychology which undergirds that political science. This leads into a direct examination of the theology of the tenth book of the dialogue. This examination shows that the theology is the natural outgrowth of the Laws advocacy of a regime dedicated to human excellence, but also that the theology points beyond the city, transcending it in such a way as to open it to continues improvement and to goods which are higher than politics. This paper argues that Heidegger’s deconstruction of metaphysics lends itself to an environmental ethic of non-violent ‘dwelling’. I trace the instrumental mode of ‘being-in-the-world’ to the beginning of Western metaphysics in ancient Greece. The root of the problem is the technological understanding of things as objects and truth as objectivity. Heidegger indicates a more primordial understanding of truth as ‘event’. For Heidegger, the emergence of a non-instrumental way of life depends upon the extent to which the technological ‘framing’ of nature (...) nature is clearly perceived. I suggest that while Heidegger’s post-foundational ethic does indeed envision a non-instrumental relation to nature, it remains unclear how such an alternative way of life may be politically achieved. Bradley and Whitehead certainly deserve a book-length comparison on such topics as experience, internal and external relations, particularly whole-part relations, time, and God. Leemon McHenry has explored these issues soberly and responsibly, and his conclusions are most informative. Yet I sometimes wonder whether the connection would be as firmly made had there not been one remark about Bradley in the preface to Process and Reality.
